These Terms of Service ("Terms") govern your use of Benjis ("we", "us", "our"), a finance tracking application and website accessible at benjis.app. By using our service, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using Benjis, you confirm that you:

  • Are at least 16 years old
  • Have the legal capacity to enter into this agreement
  • Accept these Terms and our Privacy Policy

If you're using Benjis on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.

2. Service Description

Benjis is a personal finance tracking tool that helps you:

  • Track income, expenses, and transactions
  • Manage budgets and financial categories
  • View financial insights and reports
  • Collaborate with team members via organisations

Important: Benjis is a tracking and organisational tool only. We do not provide financial, investment, tax, or legal advice. You are solely responsible for any financial decisions you make. Always consult qualified professionals for financial advice.

3. Accounts

  • You must provide accurate information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorised access
  • One person per account; sharing login credentials is not permitted
  • Team access is available through our organisation features

4. Acceptable Use

You agree not to:

  • Use Benjis for any illegal purpose
  • Record fraudulent or fictitious transactions
  • Use the service for money laundering or financial crime
  • Attempt to access other users' data
  • Reverse engineer, copy, or resell any part of the service
  • Interfere with or disrupt the service
  • Violate any applicable laws or regulations
  • Use automated systems to access the service without permission

We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscriptions & Payments

  • Free and paid plans are available
  • Paid subscriptions are billed in advance (monthly or annually)
  • Prices may change with 30 days' notice
  • Payments are processed securely by Polar
  • You are responsible for applicable taxes

Cancellation: You may cancel your subscription at any time. Access continues until the end of your billing period. No refunds for partial periods after the 14-day window.

6. Intellectual Property

  • Benjis and its original content, features, and functionality are owned by us
  • Our trademarks and branding may not be used without permission
  • Your data remains yours; we claim no ownership of your financial information
  • By using the service, you grant us a limited licence to process your data solely to provide the service

7. Data & Privacy

  • Your use of Benjis is also governed by our Privacy Policy
  • You can export all your data at any time
  • You can request deletion of your account and data
  • We process data in accordance with UK GDPR

8. Service Availability

  • We aim to provide reliable service but do not guarantee uninterrupted availability
  • The service is provided "as is" without warranties of any kind
  • We may modify, suspend, or discontinue features with reasonable notice
  • Scheduled maintenance will be communicated in advance where possible

9. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages
  • We are not responsible for financial losses arising from decisions made using the app
  • We are not liable for data loss; you are responsible for maintaining your own backups
  • Our total liability is limited to the amount you paid us in the 12 months preceding any claim

Nothing in these Terms excludes liability for death, personal injury, fraud, or other matters that cannot be excluded under English law.

10. Termination

By you: You may close your account at any time through your account settings or by contacting us.

By us: We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Fail to pay for a subscription
  • Have been inactive for an extended period

Upon termination, your right to use the service ends immediately. You may request data export before closing your account.

11. Changes to Terms

We may update these Terms and will notify you of significant changes via email or in-app notice. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
